      <media:text>  arkets. existing home sales, their biggest fall since 1999. can it get worse? and a day of extremes for merrill lynch hit by losses on sub-prime debt. the biggest quarterly loss in its 93-year history. we will speak to josh rosner and see if more problems are ahead for them. that is coming up starting at 2:00. back to you. &gt;&gt; thank you, kathleen. a big step -- a big case in the supreme court dealing with the fda regulation approval of drugs bars liability lawsuits under state laws against the manufacturers of these products. at stake is that big pharmaceutical can be sued for damages. joining us to talk about it is a traitor. when we talk   bout the liability statutes and the concerns about barring liability for these companies, lay it out in layman' s terms. -- trader. what does that mean for pharmaceutical companies? &gt;&gt; people in michigan and texas would not be able to sue drug cases. people in six other states could not be able to recover punitive damages. it is high stakes. &gt;&gt; the case was filed in 2000. what they are deciding is someone -- a plaintiff -- in a state sues a fork -- pharmaceutical or device company over problems they say are from the drugs or the devices, does the fda' s approval of the drug automatically bar lawsuits or liability? &gt;&gt; wh   t we have our eight states that say the drug companies are in one way or another immune from lawsuits unless the company defrauded the fda. the question is whether or not that fraud is valid. if not, what is left? just immunity? that would be great for industry, or nothing at all which would be bad for industry. &gt;&gt; how do you think it will shake out? &gt;&gt; i think it is an easy one. the supreme court decided on something similar to this in 2001, and i am confident they will reach the same result. &gt;&gt; which is fda approval is the last line of authority with regard to punitive damages. &gt;&gt; it would mean private plaintiffs cannot sue for fraud. in michigan and texas, most lawsuits would be under state law. in four other states, and punitive damages would not be allowed. &gt;&gt;   nless they defrauded the fda, that would be the only exception, correct? &gt;&gt; that is the hard part. how can you prove that. does it take fda itself saying that it was defrauded or can a state jury make that decision. &gt;&gt; there is the wild card because if the case comes down as you think it might, pharmaceuticals may think they won. how many instances will there be of claims of fraud? and what does it take to show -- maybe it is better for an fda regulator -- about what do you have to do to show fraud against fda? &gt;&gt; in every lawsuit, the plaintiffs say the drug company defrauded the fda. if that is allowed to go forward, the planets should say that you should   ave submitted more information. the fda itself generally does not think it was defrauded. the question is, who makes that decision? &gt;&gt; it is interesting. if the pharmaceuticals wind, it would not be clear sailing for the companies because they will most often claim fraud against the fda, regardless. &gt;&gt; if they are in favor of industry, -- the way it works is that you have a statute that gives immunity. unless the company defrauded the fda. if the supreme court knocked out the exception, all you have is immunity. what you are left with is you cannot sue the drug company. that is a good result for pharmaceuticals. &gt;&gt; thank you for </media:text>

      <media:text>  actoring in a $1.3 billion write-down for its phone unit, they posted their first loss since going public nine years ago. that said, they increased full- year profit as well as sales forecast. also, eli lilly up this morning with earnings coming in ahead of what analysts were looking for. their stock is up 9% this year. to take a closer look, the president at eli lilly and he joins us from indianapolis. &gt;&gt; good morning. &gt;&gt; what is behind the improved earnings forecast? &gt;&gt; fundamentally, sales growth. we have had solid sales growth this year and in that last half of the year we see an increase in volume. the adjusted sales growth in the third quarter included an 8% contribution from volume growth. that   s the best since 2001. &gt;&gt; i wanna talk about products but also want to talk about what is in development. analysts say earnings are not as important as the advanced studies on your anti-clotting drug and a new diabetes drug. you' re anti-clotting drug, when are you anticipating that you will release this? &gt;&gt; we have not -- speculated on the launch, but the next event will be initial data results which will be presented by a group of investigators who have been studying our drug against its competitors. that will come on november 4 as part of the american heart association meeting. &gt;&gt; what would be your ideal time   line from there? &gt;&gt; we would be filing by the end of the year after the release of the data, if it is positive. of course, there is a review cycle from the fda that typically takes 12-18 months. &gt;&gt; what about the improved version of the diabetes drug? &gt;&gt; it would only be a once a week preparation of our current product which is administered twice a day. those results will come out later this year. we have not given an exact date of the filing. we need to complete clinical trials and get them manufacturing plant started up. &gt;&gt; you also announced a deal with macrogenics. how does   hat fit into your pipeline? &gt;&gt; it gives us a technology platform. what we licensed in is a humanized antibody. when you have type 1 diabetes, where we believe this drug could be affected, your own amine system is essentially killing some cells in your pancreas that produce insulin. we believe this antibody will interfere with the process and reduce those t-sells -- cells. hopefully it will slow the development of diabetes. &gt;&gt; we also want to talk about cost. the head of the company quoted in a release this morning, talking up containing costs.   t has been an important issue for pharmaceutical companies. what can you give us in terms of indications? what are you targeting in terms of cost containment or in terms of dollar amount? &gt;&gt; we have been looking at cost across the board for several years and we are clear that we intend to grow operating expenses at a slower rate than sales. this is a multi-pronged approach. we reduced our head count the last three years by about 5000 people, mainly through managing attrition. we are controlling manufacturing expenses well. we are also using a big productivity program to improve performance across the board. &gt;&gt; with a drug company, there are so many factors given insurance. you talk about being held by the weak dollar.   lso, selling prices. given the economic environment, how does a slowdown affect what you see in terms of revenue growth and that sells off-price that you are talking about? &gt;&gt; selling prices are a function of many things, including a discount that we negotiate with the people who ultimately provide our products and pay for our products. we are pleased that most of our growth this quarter has come from volume. we expect a price environment in the next few years not terribly different from what we saw earlier in the decade. there are a lot of factors both in the u.s. and internationally that are pushing down on price. &gt;&gt; we have to leave it there, thanks for going us. have a good day. -- joining us. finally, sony is </media:text>

let me ask first about those
results that you released.
you continue to enjoy strong
growth thanks to the
best-selling cancer medicines
you have such as herceptin but
there are signs that competition
is catching up.
what do you say to that?
&gt;&gt; the whole landscape in cancer
has been fascinating.
we have been one of the first
along with our majority
ownership in genentech in
california to profile new
medicines which actually are
recollection spanning broadly
into the space.
it's going to be a rather high
hurdle for competition to
establish themselves and come
in.
i have no doubt some people will
try, but there's a lot of
mileage to go in avastin and the
vari
 us cancer drugs that we
sell.
&gt;&gt; we have a story coming out
this morning that avastin has
been approved in europe for
fighting an advantaged
advantage an
advanced stage of lung cancer.
&gt;&gt; this is europe in catchup in
this indication.
it's been here in the states
since last fall with genentech.
it has now been approved by the
europeans.
what we also have in europe this
may, we started with breast
cancer, so avastin has been
demonstrated to offer a survival
benefit in four cancer types.
this is ahead of any of the
competition.
&gt;&gt; you mentioned herceptin,
baste cancer treatment.
some analysts suggest you could
be close to market saturation
with this drug as well.
a common concern that analysts
have with large drug companies,
what do you do
 develop new
drugs?
&gt;&gt; most physicians want to start
it at a late stage in the
disease.
that's usually the first
registration.
then ultimately you get to
earlier stages in the cancer and
hopefully ultimately to what's
called the adjuven setting, so
once the cancer has been
surgically removed to try to
prevent the cancer from coming
back and there is concern
whether it can further benefit
ladies with breast cancer.
is this a one-horse drug
company?
is cancer your main reliance?
there is concern that drug
companies aren't developing band
new treatments for other
diseases, just relying on
improvements to the ones that
they have.
&gt;&gt; for rosch, we are making a
major impact into the treatment
of hepatitis where the majority
 wner of the product that is 60%
of market share here in the
united states and around the
world, we have some very
interesting products coming
through in roim
rheumatoid arthritis.
one of the products in the early
stages now and has been used in
late stage rheumatoid arthritis.
we're studying it earlier, and
we have a brand new mechanism
which is in our drug, with three
out of the four pivotal studies
that we will need to satisfy the
f.d.a. and european authorities,
and those results are coming in
impeccably and we will be
submitting by the end of this
year.
whether it's transplantation,
virology, or tamiflu, for
example, we have helped many
world governments get to a stage
of preparedness for the
pandemic.
we do believe we have more work
to do in the states.
the most recent announcement
from the government showed that
they're still not fully up to
the targets of preparedness they
wanted to be.
one thing coming out of u
 courts, amgen's suit against
rausch over its anemia drug has
to go to trial.
is this a big setback for you?
&gt;&gt; no, this is as predicted and
as amgen has signaled.
we are not a patent breaking
organization.
we have our patd ents published
in the united states and we look
forward to a judgment in boston
in the fall adjudicating our
rights.

sales, which is typically as we
measure it.
the stock is down about 4
percent, give or
 ake a four
month low.
pfizer, disappointment.
analysts, clearly investors are
saying that.
even the company has the word
discipline is their own press
release -- were disappointed in
their own press release.
j.p. morgan referred to it as
limping along.
clearly not a lot of happiness
as the results came out.
as well as of the pfizer deal 9
forecast for this year and next,
exactly where they are already
priced in.
16% decline from a year ago gets
you to 42 cents a share.
the sales globally were down
6%, 11 billion.
but also missed a 11.4 billion,
the average estimate you can see
the decline there.
take a look at the real
culprit, lipitor sales in the
u.s. were down
 5%.
that is their best selling drug.
it does give or take a building
dollars a month in revenues.
outside the u.s., lipitor sales
were up 5%, but the total haul
with the decline in the u.s. saw
its 13% klein, but behold, a 25%
decline really points up the
errors.
with the sales and the
competition and uncertainty as
to how they will adapt to the
changing health-care
marketplace, they pointed out
the cost cuts are not there, and
the costs remain high, and that,
combined with a disappointment
number in celebrant and hit some
of their top-selling drug addict
to the 4% decline -- celebrex.

i asked him how important the
biotech industry has become to
them.
&gt;&gt; manufacturing accounts for
40% of our gdp.
those are the most important
sectors.
we have been a manufacturing
powerhouse of pharmaceutical
products for many years, and now
we are quickly becoming a
powerhouse of biological health.
we have landed deals with amgen,
eli lilly, other organizations.
we are looking for more, and
 he
results are very impressive.
&gt;&gt; as governor, you have made
support for the biotech
industry a public priority.
you called in the bio island.
why?
&gt;&gt; we have been so successful in
producing the products.
we have the elements in terms of
experience from pharmaceutical
companies.
we have the professionals
needed, the engineers, ph.d. in
science.
we have access to the u.s.
market.
and as you mentioned, we are
outside of the u.s. for tax
purposes, but part of the
commonwealth for other
protections that companies need.
in terms of biotech for
example, five years ago we only
had one operation.
now, four years after, 25
percent of all the world output
of biologic
 omes from pr.
we are ready for more and that
is why i am here in new york, to
attract more investment to the
island because the stories are
very successful.
in that sense, it is a
combination of good business
claims and tax incentives and a
high quality of labor that we
have in pr.
&gt;&gt; talk to me about the larger
economy, despite progress and
attracting by attack, you are
facing a recessionary time.
you have a 10% unemployment
rate.
&gt;&gt; in terms of the unemployment,
i agree it is high.
it has been a problem for the
last 20 years.
precisely, to jump-start the
economy and move to a new
economy, the new public policy
is to move pr to a more
knowledge based economy, to not
only
 o into the manufacturing
of biotech products, but
research and development.
we are investing in education,
science and math.
the presence of big
pharmaceutical companies on the
island has a strong relationship
with the people in my support
will get that new investment
needed to move for rico'
economy forward.
i agree that is a main issue.
we are very much committed to
attract new commitments and
foster investment and
development of small companies
from pr.
&gt;&gt; what about the fiscal issues?
there was a government shutdown
last year.
you are looking at a budget
shortfall this year, will you be
able to balance that have beset
by the next fiscal year?
&gt;&gt; for the fourth consecutive
year we will be spending less
money.
the first time in history when
we have
 irst -- real fiscal
responsibility.
the budget i announced is
smaller than the current budget
and expenses.
in that sense, we are solving
fiscal problems.
we have a plan that is moving
forward.
there is no threat of a
government shutdown.
the end of the fiscal year is on
june 3.
that was one of the big problems
i inherited.
we are solving that problem.
we are ready in june or july to
have a $1.5 billion bond issue
of government sponsored bonds.
another $5 billion bond issue
will probably happen in july or
august.
i think the markets are going
to welcome pr and isn'
t -- the
decisions we have made are put
through the house.
that is another good reason why
i am confident and optimistic
that our economy will move
forward.

the health-care industry is
getting ready for a new movie
from michael moore.
it deals with the health-care
industry, it is called roy
blunt -- it is called "sicko"
we spoke to a crisis management
consultant, we got his take on
exactly how the industry should
respond.
&gt;&gt; michael moore has taken on
the automobile industry, the gun
lobby, and president bush, his
latest film takes aim at the
health-care industry.
here is a sneak peek at the
film.
&gt;&gt; i had a piece of wood, i
grabbed it.
&gt;&gt; he saw the top -- sawed off
the top of two of his fingers.
&gt;&gt; i did not have ins
 rance.
&gt;&gt; the hospital gave him a
choice, reattached the middle
finger for $50,000, or the ring
finger could be reattached for
$12,000.
&gt;&gt; he wanted -- it wanted him to
put a value on his body.
&gt;&gt; he chose the ring finger, for
the bargain price of $12,000.
&gt;&gt; the drug and insurance
companies are reacting to the
film'
s release in a statement
earlier this month.
the manufacturers of america
said that they could find ways
to improve america'
s health-care
system.
but the one-sided attack would
not help the cause.
what will this film did to the
industry?
we have the ceo of technological
resources, he is the author of a
famous book, "everything you
know about crisis management is
wrong."
he wants to talk about the
health-care industry, and
whether or not they s
 ould be
worried.
&gt;&gt; they should be worried.
they'
re in a battle with
conventional forces in the
health-care industry.
he has a great story, and the
industry is simply not equipped
to respond to a guerrilla
fighter will there -- to a
guerrilla fighter.
will there be a response?
they have to do what they do not
have to do, which is fighting a
guerrilla war.
&gt;&gt; will be the advice that you
would give them?
&gt;&gt; do not attack him personally.
attack the message.
he wants you to attack him
personally.
he wants it to look like it is a
dirty trick.
but what third parties to attack
him and his credibility.
secondly, there are
opportunities to be able to
explain this.
 ell the different stories of
people who did not do well in
cuba.
places where the people have
seen better recovery.
tell the alternatives to the
other stories.
that is far better.
it is better than individual
companies going after him.
there is nothing to gain by this
personally.
&gt;&gt; he had previous films, he has
a long list here.
they'
re taking aim at specific
targets.
&gt;&gt; the goal of the industry is
to lose by fighting less.
the way that you do this is that
you do not debate him by keeping
this going longer than it would
otherwise.
you have to have very simple
characterization'
s that take it
out of the news faster than it
would if you engage in world war
three.
if you declare war on him, there
is a chance that he will
 in.
the industry is very
conservative and needs to be so
in their response.
&gt;&gt; last week, there was an
advertisement, it was an
invitation with 1000 names in it
to the lobbyists of the health-
care industry.
all the names were in the
advertisement.
i am not sure if anyone showed
up.
it may drop even more attention
to this film.
&gt;&gt; that is his real genius --
draw even more attention to this
film.
&gt;&gt; that is his real genius.
he is a bomb thrower, never
fight him.
it is a clever tactic to get
health care industry
professionals involved.
&gt;&gt; why not go after him
personally?
there are questions about
whether he is truthful,
 ut not
call him on this?
&gt;&gt; people can, but it should not
be health care companies.
why would you want to inject
yourself into this?
have think tanks and like-minded
parties involved.
if i were counseling the
individual company, and i have
seen this done, i do not see why
the drug companies gain by
fighting him.
this is my job.

record close but has retreated.
exon, j.p. morgan, pfizer will
be the biggest drags on the s&amp;p
-- exxon mobil.
bristol-myers -- there is
speculation it could be a
takeover target again.
the latest speculation comes
after the court victory on
plavix reassured potential
suitors.
we will have a closer look with
shannon the covering the drug
 stock.
this speculation and it seemed
is around every few months when
it comes to this particular drug
company.
why is it such an attractive
target, and why now?
&gt;&gt; basically a lot of the
world'
s drug companies need new
products.
they are facing a generic
competition and they have had
some major research setbacks.
bristol-myers had some of the
best pipelines in the drug
industry, analysts say,
especially on a oncology.
that is why they are looking at
it now.
with the plavix decision, it
puts a lot of risk behind them,
and bristol-myers is one of the
most attractive.
&gt;&gt; with plavix being the top
seller and staving off generic
drugs stable cash flow is
anticipated for sales.
there is a lot of analyst -- are
a lot of analysts
 otes, a lot
of names banded about.
&gt;&gt; sanofi is a top mentioned,
they are a partner with bristol-
myers on plavix.
also sanofi had a setback if you
weeks ago where they had a
weight loss drug that it wanted
to market, and a panel of fda
advisers recommended against it.
it does not look like it is
likely that it will make it to
market in the u.s..
so they are even in more need
for new drugs.
pfizer will lose $21 billion in
annual revenue by 2011 from
generic competition.
they are nothing nearer
replacing that in development.
so, they need new drugs, and
fast.
and bennett glaxosmithkline has
been mentioned.
they had some -- and then at
glaxosmithkline has been
mentioned, they had a heart
concerned w
 one of their new
drugs.
&gt;&gt; have you heard that talks
are going on?
have the company -- has the
company said it would be open to
negotiation?
&gt;&gt; there have been sources that
said certain companies have
hired investment bankers.
pfizer said it everything is on
the table.
but pfizer has gotten burned by
mega mergers in the past but did
not turn out the way it hoped.
a lot of analysts say that
pfizer may not have the stomach
for a big merger again.
&gt;&gt; what about any kind of
potential premium?
again, in the context that
bristol-myers has been a
speculative target for so long.
how much is already priced in
the?
&gt;&gt; it looks like analysts say
between $35, up took $40 -- it
is trading at about $32 today.
it is a better premium they
 talking about before the plavix
deal yesterday.
&gt;&gt; in terms of who is not on the
list of potential acquirers, and
one that pops up as interesting?
&gt;&gt; the one interesting -- if
there is a dark horse, it could
be schering-plough.
they just did a big deal, so
maybe they are out of it.
but their ceo had been in the
running to be the bristol-myers
ceo.
it was rumored that he said,
yes, i will be your ceo if you
take my company and maybe at
times -- at a time bristol-
myers was not ready for that.
&gt;&gt; we are seeing the shares
down 0.25 percent right now but
they were up yesterday just over
four percent.
